DUI Dismissed- Woman’s Body Creates Alcohol

A New York judge dismissed a woman’s DUI charge after seeing evidence that she suffers from “auto-brewery syndrome,” also known as gut-fermentation syndrome. This can occur when abnormal amounts of gastrointestinal yeast convert common food carbohydrates into ethanol.

In this case, the woman blew .40 but reportedly consumed four drinks over six hours, which should have placed her alcohol level at 0.01 and 0.05 based on her height and weight. Police reported she was weaving her vehicle all over the road and exhibited bloodshot eyes and slurred speech.

Experts say that part of the syndrome’s mystery is how someone can have extremely high alcohol levels and still be walking around and talking, when the average person would be comatose or dying.

The District Attorney’s office reportedly will appeal the judge’s ruling.
